I am waiting for my glasses. Meanwhile want to ask you if I need any extra tool/fix for 3D Vision support in Diablo 3 or does it work from out of box?

Diablo 3 does not require a fix. I think the one available is obselete.
The only requirement for full 3dvision support in D3 is you must remove the profile from the game using Nvidia inspector. Then it works perfectly. Otherwise you get some issues with shadows and such

It works perfectly for me. I have been playing recently because of the necromancer update, leveling one to 80 so I have seen pretty much all the areas in the game.
So are you sure you are actually removing the right profile? lights and shadows are only an issue if it uses one, nothings changed for me.

Is this way safe from bans by Blizzard?
