Yes, try the Beta driver. I'd recommend doing a full install. The 3D Vision User Guide may help you as well. http://www.nvidia.com/content/3dvision/docs/3dvision-universal-install-guide-may11.pdf
You might read thru the sticky Notebook not showing "Stereoscopic 3D" option in the NVIDIA Control Panel with R275.33 , there's mention of people having problems when upgrading from an OEM driver.

When the game initially launces, there is an overlay that states the rating for 3D Vision with the game being launched. It'll tell you sometimes to turn off/disable certain video features of the game such as motion blur, shadows, etc... This overlay is disabled/enabled by cntrl-ant-insert.
Are you using the "Run Setup Wizard"?

The issue in that thread refers to the entire 3d vision panel not showing up. My only issue is the same for which birkarizma posted a screen shot above.
Yes the overlay is there. I just can't toggle effects. That is the issue and some games are known to not work properly unless you toggle effect AFTER the game has already started. The setup wizard was the first thing I ran and it works perfectly. the only issue is the shortcut and no way to toggle 3d effects on and off in a game.

I'll try reloading the defaults in the BIOS tonight.
Are you able to use 3D properly

Yes, other games play fine. I just can't turn 3d Effects on and off using the shortcut. it's annoying.
