That's not a bug, V Sync is always on by default in the drivers when in 3D Vision mode on 120Hz 3D Vision ready monitors. Andrew@nvidia mentioned this recentley.

Well there is definitely something wrong with DX11 performance with 3D turned on. With the latest drivers and game patch the game runs great in 2D but once I activate 3D my frame rates drop to about 30%, or even worse at times. The DX9 renderer doesn't have this issue for me and I am pegged at 60 FPS almost all the time. I have all the settings maxed out, with the exception of depth of field and motion blur turned off, because I don't really like that in games. I also disable ambient occlusion because it causes weird shadow issues around characters in 3D.
I ended up finishing the game in DX9 because, quite frankly, I couldn't tell a big difference in image quality between the two render modes. I did enjoy the story of the game but I wish it was longer and I really got tired of "follow Connor" all the damn time. The last level pretty epic though and I wouldn't mind a sequel.

I'm refering to Samsung HDTVs in checkerboard, not monitors, so it is a bug.
