The thing with dx12 is that older GPUs will not "fully" support it, which is pretty much a given and known. There are some things that are not possible on the older GPUs and some things will have to be emulated or not used. With dx12 Microsoft made it so that older GPU's could take advantage of some of the new API without requiring a mandatory hardware update. On an older GPU, just being able to use dx12 will be a bonus because of the lower overhead of the API, as well as better CPU utilization.
Cards getting dx12...to the extent that's possible to support them.

Prior to the most recent driver, Win10 was questionable. With the latest driver, some other people in the forum have done some good extensive testing, and it looks to be at parity with Win7. No big win or loss for either OS, with the possible caveat that you only really have a single driver to use on Win10 at present. I personally prefer to have options, and one driver is not going to change my current skepticism of NVidia.
If you want to stay with Win10, that seems OK at this point.
For the question about DX12, it's not going to happen for quite awhile, this is not a decision point today. As enthusiasts we tend to look at the bleeding edge stuff, but DX12 isn't going to be mainstream for at least a year, maybe longer. Game developers cannot afford to commit to DX12 exclusive, and lock out the vast majority of gamers who may not have DX12 cards or Win10 to use it. If you don't believe me, take a look at the Steam hardware survey.
Also, remember DX10? That's right no one does. Exclusive to Vista. Not sure how Microsoft missed that lesson.

Path of Exile moght be cool because it requires you to tweak convergence and depth to align the unit icons. Good practise

Yah, while depth has a graph bar, convergence does not. So you need to adjust it by peering over the top of the glasses, also keep in mind that sometimes it can be 30 seconds of holding the keys before the adjustment begins.

Some of the games are 3D Vision Ready and do not require a fix. Tomb raider and the trine series, are such games. I'm also fairly certain that Diablo 3 doesn't need anything. In most cases, these games will require that you enable 3D via their in-game menu.

I honestly think nVidia sabotaged their awesome product with the baffling 10% default depth, which certainly made me scared to increase depth to the 100% most of us use and the locked off convergence.
The fade-to-white, at the start of Portal 2, was all the time needed for my anti-3D (because of the movies) colleague to state, "Gaming in 3D is NOT a gimmick". :)

Due to the camera angle I think. (looks odd in 2d) Path of Exile has the best toyification I have seen in any game, and yes as long as you wack depth up to a healthy amount (if not 100) and push convergence until the mouse cursor is just above your characters head, it's nearly perfect.
I'm not to worried about HUD's being at depth for the most part.

If you are worried about changes in your family, work or any other social relations you should never install The Witcher 3!
Because, if you do, those relations and also you, as a person, will never be the same.
Witcher 3 will eat you!
If you dare start experiencing that world you would find very difficult to want to return to the (so called) real world.
No but seriously, IMO, The Witcher 3 is the apex of 3D awesomeness. (Thanks again to the Helixmod people)
In reality, this isn't worth it. You need to wait for the 3D headsets that are coming about in 2016. They have the 3D type that is more supported and more popular. IF you do insist on getting the 3Dvision glasses though, you'll find yourself amongst the many in this section that are constantly complaining about it but at the same time saying how great it is...
