I can’t speak for AVP, but Mass Effect never once made the promise of anything 3D and, atleast for me, worked perfect out of the box. BioShock2 was a big disappointment with the 3D out of the box … but I have ME2 to tide me over until a patch. As far as BC2 I don’t have a problem with it happening this way solely because they have informed us of the situation before launch.
